Terms of Service

1. Acceptance of Terms

By using Kit ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Kit is an AI-powered app builder that allows you to create progressive web applications (PWAs) on your device. Apps you create with Kit are stored locally on your device and are not transmitted to or stored on our servers unless you choose to use the Share feature.

3. Local-Only by Default

All apps you build with Kit exist solely on your device. We do not collect or store the content of your apps unless you explicitly use the Share feature described below.

4. Share Feature

Kit provides an optional Share feature that temporarily makes your app accessible to others via a temporary URL. By using the Share feature, you acknowledge and agree that:

Your app's files (HTML, CSS, JavaScript, images, and other assets) will be made publicly accessible beyond your device via a temporary URL.
Shared apps are automatically removed after a short period. The Share feature is intended for temporary sharing only, not permanent hosting.
You are solely responsible for all content you share through the Service.

5. Prohibited Content

You must not use the Share feature to upload, distribute, or make available any content that:

Is illegal under applicable law, including but not limited to child sexual abuse material (CSAM), which will be reported to the relevant authorities;
Infringes on the intellectual property rights of any third party, including copyrights, trademarks, or patents;
Contains malware, viruses, phishing schemes, or any code designed to harm or deceive users;
Constitutes fraud, impersonation, or misrepresentation;
Contains defamatory, threatening, or harassing material;
Violates the privacy rights of any third party, including sharing personal data without consent;
Promotes or facilitates illegal activities.

6. Enforcement

We reserve the right to remove any shared content and terminate or suspend your access to the Service at our sole discretion, without prior notice, for any violation of these Terms. We may cooperate with law enforcement authorities and comply with court orders requesting or directing us to disclose the identity or other information of anyone using the Service.

7. Reporting Abuse

If you encounter content shared through Kit that violates these Terms or applicable law, please report it to jonk.support+1@proton.me. We will review and act on reports promptly.

8. Copyright Claims

If you believe content shared through Kit infringes your copyright, please contact us at jonk.support+1@proton.me with a description of the copyrighted work, the URL of the infringing content, and your contact information. We will respond to valid claims promptly.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that shared content will remain available for any specific period.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Kit and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service or any content shared through it.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of Japan. Any disputes shall be subject to the exclusive jurisdiction of the courts of Japan.
